
The Economic and Organised Crime Office (EOCO) has finally responded to the investigations and issues surrounding the Auditor-General, Mr. Daniel Yaw Domelevo in a press statement released on Wednesday, 27th November, 2019.
The EOCO has set the records straight regarding whether EOCO has the legal mandate to investigate procurement breaches. As it is held by the opinion of some that the Office of the Special Prosecutor is the sole body authorized to investigate all suspected procurement breaches.
“It should be noted that Section 79 of the Office of the Special Prosecutor Act, Act 959 is limited to corruption related offences under the serious offences category of the EOCO Act. It does not outs the jurisdiction of EOCO from investigating other serious offences that are not necessarily of a corruption related nature” the press statement stated.
Therefore, the impression that EOCO’s jurisdiction is totally ousted by Act 959 is therefore erroneous and the public should be advised accordingly.
EOCO assures all stakeholders that it works with utmost respect for the rule of law, human rights and respect for the Constitution of the Republic of Ghana.
